This application is filed to vacate the order dated 23.12.2016 in WPMP.No.55794 of 2016 in the above writ petition.

Parties will be referred to as per their array in the Writ Petition.

Petitioners are Women Head Constables who had been promoted on 29.06.2016 to the said post from the post of Police Constable by the 4th respondent. They had also undergone pre-promotion training, before being given said promotion.

However, by the impugned order dated 20.12.2016, both the petitioners were reverted from the post of Women Head Constable to the post of Women Police Constable on the ground that the seniority list of Women Police Constable of 2009 batch came to be revised as per G.O.Ms.No.374, Home (Police.C) Department, dated 14.12.1999 by the proceedings dated 19.10.2016 of Director General of Police, Telangana State, that said reversion was done on the ground of marks obtained at the initial recruitment as Women Police
Constable, and also on the basis of marks obtained in prepromotional training, whereas the promotion of the petitioners was affected on the ground of their date of appointment which was not the correct principle. 5.
It is stated by the respondents that as a consequence of the revision in the seniority on the basis of the marks as mentioned above, the position of the petitioners in the seniority list was altered to 12 and 6 respectively and therefore they were required to be reverted.

The explanation offered by the respondents appears to be correct, since admittedly, it is not a case of reversion as a result of punishment, but it is a case of reversion by rectifying an error committed when petitioners were initially promoted. 7.
Though, it is unfortunate that the petitioners have to suffer reversion on that ground, I feel that interest of justice would be met if the vacancies in posts of Women Head Constable are available in the unit of Medak and the cases of the petitioners are considered in accordance with the modified seniority list applying the rule of reservation. This exercise shall be done within eight (08) weeks from the date of receipt of copy of the order.

Accordingly, W.V.MP.No.155 of 17 is allowed to the above extent and W.P.No.45260 of 2016 is disposed of in terms of the above direction. No costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
