THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22275 OF 2016 ORDER:

Heard the learned counsel appearing for both parties and with their consent, the present Writ Petition is disposed of at the admission stage.

2 . The present writ petition came to be filed with the following prayer:

"t o issue an appropriate writ or direction more particularly a Writ in the nature of Mandamus declaring the action of respondent Nos.3 to 5 in laying the road in the land in Sy.No.214, admeasuring Ac.0-30 Cents of Sy.No.214 of Madhurawada Village, Chinagadil Mandal, Visakhapatnam, in which the petitioner is in possession, without following the due process of law is illegal, arbitrary and unconstitutional and consequently direct the respondents not to interfere with the possession of the petitioner over the schedule property i.e., the land in Sy.No.214, admeasuring Ac.0-30 cents of Sy.No.214 of Madhurawada Village, Chinagadil Mandal, Visakhapatnam."

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents not to interfere with the possession of the petitioner over the subject property without following due process of law.

4. Learned Government Pleader submits that no steps are taken to lay a road through the land of the petitioner, and no action will be initiated by the respondents without following due process of law.

5. Having regard to the submissions made, and without going

into the merits of the case, the Writ Petition is disposed of directing respondent authorities not to take any coercive steps against the property in dispute without following due process of law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
