Heard Sri K.Amarnath Reddy for petitioner and Assistant Government Pleader for Home for respondents.
On 10.11.2016, at request of respondents, the writ petition was adjourned to today. In spite of granting sufficient time, the respondents have not sent instructions to the Assistant Government Pleader.
This Court, having regard to the orders already passed in this behalf in Writ Petition No. 39888 of 2015, dated 09.12.2015, disposes the instant writ petition by following the decision in Writ Petition No. 39888 of 2015 dated 09.12.2015, with a direction to respondent No.3 to consider for release of the seized vehicle. The petitioner is permitted to make application to respondent No.3 for release of the seized vehicle. Respondent No.3 is directed to consider such application and pass appropriate orders as per G.O.Ms.No.3, Industries and Commerce (Mines.I) Department, dated 08.01.2015 as amended by G.O.Ms.No.5, Industries & Commerce (Mines.I) Department, dated 19.02.2015 for release of the seized vehicle, within a period of three days from the date of receipt of application.
