ORAL ORDER:

Petitioner is aggrieved by building permission granted by the Gram Panchayat to 5th respondent by placing reliance on letter written by the District Panchyat Officer, Jagtiyal informing the Panchayat Secretary that since an appeal is pending against the judgment rendered by the trial Court, building permission application should not be processed/granted without properly verifying the documents. Petitioner contends that the action of 4th respondent in issuing permission for construction of the house to 5th respondent is illegal. 2.

It is seen from the material on record that building permission was granted on 18.7.2017. Against the order of the Gram Panchayat granting building permission, appeal lie to District Collector. Though, petitioner claims to have submitted a representation to the District Collector on 9.11.2018, it is not an appeal and except stating that there is civil litigation pending, no other grounds are urged in the said representation.

At this stage, learned counsel for petitioner seeks leave of the Court to file appeal by raising all grounds permissible in law. 4.

Recording the same, granting liberty to petitioner to file appeal, if so advised, to the District Collector, against the building permission granted to 5th respondent, this writ petition is disposed of. It is needless to observe that as and when such appeal is preferred, after putting on notice the 5th respondent and affording due opportunity, shall pass appropriate orders as warranted by law within a period of six weeks from the date of receipt of appeal assigning reasons in support of the decision.
