PNR,J WP No.41994 of 2018 ORDER:

Petitioner submitted that 6th respondent applied permission to construct Poultry Farm Shed in the land adjacent to existing temple. Having come to know that such application was made, objections were filed opposing establishment of Poultry Farm adjacent to the temple as it would create lot of problems to the devotees. It appears such complaint was made on 22.10.2018. Alleging those objections have not been considered and the competent authority is in the process of issuing permission, this writ petition is filed.

A reading of the averments in the affidavit filed in support of the writ petition itself would show that so far no such permission was granted and petitioner only apprehends that without considering their objections, permission likely to be granted. Thus, as no such permission is granted by the Gram Panchayat, Court cannot entertain the writ petition and direct the authority to take a decision in a particular manner even before a decision is made. Writ petition is dismissed as premature, leaving it open to petitioner to avail appropriate remedy as available in law as and when such permission is granted by the Gram Panchayat without considering the objections and not properly appreciating the objections.
