HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41922 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondent authorities encouraging the illegal construction on the hill, which is causing hardship to the petitioners' life and property, as illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India apart from Municipal Laws. Though various grounds are urged, learned counsel for the petitioners submits that the petitioners submitted a representation, dated 27.06.2018, to respondents 2 to 4, bringing to their notice the threat to the petitioners' life and property because of the unauthorized construction on the hill without taking appropriate permission, but no action has been taken so far.

On the other hand, Sri Balaji Medamalli, learned Standing Counsel for the Vijayawada Municipal Corporation, submits that the City Planner, Vijayawada Municipal Corporation, Vijayawada, went to the houses of the petitioners, but he did not find any unauthorized structures raised on the hill above the houses of the petitioners. The City Planner tried to contact the petitioners at their houses, but none of them are available. Hence, the petitioners may be directed to approach the City Planner and submit a representation for redressal of their grievance. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing one of the petitioners to approach the City Planner, Vijayawada Municipal Corporation, Vijayawada, and submit a representation, by enclosing all the documents, for redressal of their grievance, within a period of one (01) week from today. If any such representation is made by the petitioners, within the time stipulated above, the City Planner shall verify the same and shall deal with the

request, as expeditiously as possible, in accordance with law, and if necessary, after proper inspection of the site. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
