THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.5731 OF 2017 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India for non-disposal of I.A.No.1213 of 2017 in I.A.No.263 of 2014 in O.S.No.5 of 1996 by the learned III Additional District Judge, Tirupati.

The only relief sought by the learned counsel for the petitioners is to direct the trial court to dispose of I.A.No.1213 of 2017 in I.A.No.263 of 2014 in O.S.No.5 of 1996 as expeditiously as possible.

Today this Court allowed C.R.P.Nos.5600 and 5728 of 2017 setting aside the order dated 04.09.2017 passed in I.A.No.263 of 2014 in O.S.No.5 of 1996 on the file of the Court of the III Additional District Judge, Tirupati.

In view of the submission made by the learned counsel for the petitioners, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, it is a fit case to allow the revision.

In the result, the Civil Revision Petition is allowed directing the learned III Additional District Judge, Tirupati, to dispose of I.A.No.1213 of 2017 in I.A.No.263 of 2014 in O.S.No.5 of 1996, as expeditiously as possible. There shall be no order as to costs.
