HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10463 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not paying the remuneration to the petitioner as Village Electricity Worker in Sarvapur Village, as illegal and arbitrary. A consequential direction is also sought to the respondents to pay the remuneration to the petitioner with all attendant benefits.

Heard Ms. K. Udayasri, learned counsel for the petitioner, and Mr. P. Sri Raghuram, learned standing counsel for the respondents. 3.

It is the case of the petitioner that he was selected and sponsored to work as Village Electricity Worker by the Sarpanch of Sarvapur Village vide resolution dated 20.01.1989 and since then he has been working as such. His grievance is that though he has been working continuously as Village Electricity Worker without any break, he is not being paid salary for the work done by him. Hence, he made a representation to the respondents on 22.12.1998, but the same is still pending consideration.

Having considered the submissions made by the parties, this Court, without expressing any opinion on the merits of the case, is of the considered view that the writ petition can be disposed of with a

direction to the respondents to consider and pass appropriate orders on the representation of the petitioner.

Accordingly, the writ petition is disposed of with a direction to the respondents to consider the representation of the petitioner dated 22.12.1998 and also on a fresh representation which the petitioner intends to submit, and pass appropriate orders thereon within a period of six (6) weeks.
