Heard both sides.

The suit O.S.No.305 of 2016, pending on the file of the III Additional Senior Civil Judge, Vijayawada is withdrawn and transferred to the file of the II Additional District Judge, Vijayawada, to try along with O.S.No.418 of 2016, because item No.2 of the said partition suit in O.S.No.418 of 2016 is the subject matter of the injunction suit in O.S.No.305 of 2016 and the evidence being adduced is between the same parties in relation thereto also, to avoid conflict of judgments, duplication of evidence and to save time. Needless to say subject to other preferences for giving early disposal by joint trial of both matters.

Accordingly, this transfer civil miscellaneous petition is allowed. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
