HON'BLE SRI JUSTICE SURESH KUMAR KAIT C.R.P.No. 6026 of 2017 O R D E R:- This Civil Revision Petition is filed assailing the docket order dated 06.10.2017 in C.F.R.No. 2900 of 2016 in O.S.No. of 2016 (unnumbered) whereby the Principal Junior Civil Judge, Narasaraopet, even without numbering the suit, rejected the plaint filed by the petitioner.
Sri Nimmagadda Venkateswarulu, learned Standing Counsel for Narasaraopet Municipality appearing on behalf of the respondent, does not dispute that the impugned order is erroneous and submits that the petition filed by the petitioner has to be numbered and heard on merit.
In view of the fair submission of the learned Standing Counsel, the order dated 06.10.2017 passed in C.F.R.No. 2900 of 2016 is set aside and the trial Court is directed to receive the plaint, number the suit and dispose of the matter as per law after giving an opportunity to both the parties to be heard.
With the above observation, the Civil Revision Petition is allowed. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
