HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24672 of 2016 ORDER:
This writ petition is filed seeking a writ of Mandamus declaring the action of the respondent authorities in not taking any steps to stop the construction of sluice at 'Utagunta' of Subrahmanyam village, Balayapalli Mandal, SPSR Nellore District, as being illegal, arbitrary and un-constitutional.
2. Heard the learned counsel for the petitioner, the learned Government Pleader for Irrigation and Command Area Development (Andhra Pradesh) and Sri T.G.Prasad Reddy, learned counsel appearing for respondents 6 to 25.
3. At the time of hearing, learned counsel for the respondents submitted that the very purpose of filing of the writ petition has become infructuous in view of the completion of the sluice work.
4. Learned counsel for the petitioner in all fairness admitted that the entire work of construction of sluice was completed.
5. Having regard to the facts and circumstances of the case, the very purpose of filing of the writ petition has become infructuous. Hence, the writ petition is dismissed as infructuous. However, dismissal of this writ petition does not preclude the petitioner to approach the competent authority for redressel in respect of the quality of the work. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
