CONTEMPT CASE No.669 OF 2016 ORDER:

This Court passed the interim orders as prayed in W.P.M.P.No.34999 of 2015 in W.P.No.26948 of 2015.

2. The interim orders sought is, to direct the 4th respondentcorporation not to allow the 5th respondent to raise illegal construction in the land belonging to Bujjamma Choultry, situated at Ranganayakulapeta, Nellore town. Alleging that the said order is violated and construction by the 5th respondent is allowed, this contempt is filed.

3. In the counter affidavit filed by 1st respondent herein, who is the 4th respondent in the writ petition, it is categorically asserted that the property on which the 5th respondent is undertaking construction does not belonging to Bujjamma Choultry. Bujjamma Chountry property is in CAS No.787/2, whereas the construction is taking place in CAS No.44 of Nellore. Due permissions were obtained from the Municipality in construction of the subject building.

4. The 3rd respondent herein, who filed counter affidavit on behalf of 6th respondent in the writ petition, categorically asserted in paragraph-4 of the counter affidavit that the subject property is not a property of the 6th respondent in the writ petition.

5. In view of the same, there is no merit in the contention that the respondents violated the orders of this Court. Contempt case is accordingly closed.

Miscellaneous petitions pending, if any, in this contempt case shall stand closed.
