THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28137 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus declaring the proceedings in Notice No.E1/1527/2016, dated 05.8.2016 issued by the second respondent as illegal and arbitrary.
2. Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Co-operative Societies representing respondent Nos.2 and 3.
3. The petitioner is the Secretary of the first respondent by name "the Chilakaluripet Recreation Club". The first respondent- Club was registered under the Societies Registration Act vide Regd. No.7/1942. Its President and Vice-President filed a complaint against the petitioner and in pursuance thereof, the second respondent has issued the impugned notice directing the petitioner to produce all the records pertaining to the first respondent-Society on or before 12.8.2016. The petitioner submitted his reply notice/representation dated 11.8.2016 and statedly it is not yet disposed of by the second respondent.
4. At the time of the arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of the reply notice/representation of the petitioner dated 11.8.2016. The learned Assistant Government Pleader also consented for the same.
5. Having regard to the facts and circumstances of the case and in view of the submissions made by learned counsel for both the parties, the second respondent is hereby directed to pass appropriate orders basing on the impugned notice and reply notice/ representation dated 11.8.2016, as expeditiously as possible, preferably within a period of one month from the date of receipt of a copy of this order.
6. With the above direction, this writ petition is disposed of. Miscellaneous petitions if any pending in this writ petition shall stand closed.
