2018-11-22A.Rajasheker Reddy2 pages

THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.41988 OF 2018

O R D E R

Aggrieved by the inaction of the 4th respondent - Tahsildar, in considering the online application made by the petitioner on 06.08.2018 and subsequent representation made on 10.08.2018, for correction of names in revenue records in respect of the subject property, the present writ petition is filed.

Learned Assistant Government Pleader for Revenue, produced written instructions of 4th respondent stating that civil litigation is pending between the parties in respect of subject property and as such, the application of the petitioner for correction in the revenue records, could not be considered.

Learned counsel for the petitioner submits that suit in O.S.No.279 of 2008 filed by one Thumma Kasapa Reddy and others against the petitioner for permanent injunction, was dismissed on 28.04.2016 and thus no civil litigation is pending.

It is to be seen that when the petitioner made application for correction of his name in the revenue records, instead of keeping it pending, the 4th respondent is required to consider all the aspects and after issuing notices to the interested parties and affording them opportunity of hearing, shall pass appropriate orders in accordance with law.

In view of the same, the 4th respondent is directed to dispose of the application stated to be have been made by the petitioner through

online on 6.8.2018 and representation dated 10.08.2018, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

Writ petition is disposed of accordingly.

Interlocutory applications pending, if any, shall stand closed. No costs.
