HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P.No.20 of 2016 ORDER:
This petition is filed to withdraw O.P.No.65 of 2014 from the file of Family Court, Vijayawada, Krishna District and transfer the same to Family Court, Ranga Reddy District at L.B. Nagar.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 21.08.2008 at her native place i.e., Velpur village in Guntur District, as per Hindu rites and caste custom and after marriage she joined respondent at Vijayawada where he was doing civil contracts and they lived happily for 3 years and thereafter respondent started harassing her and that she was necked out with her children from matrimonial home and having no other alternative she went to her native village and residing with her grand parents and thereafter she was shifted to Hyderabad where her parents are staying and that she filed DVC and maintenance cases at Hyderabad. She stated that respondent filed O.P.No.65 of 2014 before Family Court, Vijayawada and she is apprehending danger to her life a t Vijayawada.
She further stated that the distance between Vijayawada and Malkajgiri, Hyderabad is more than 280 KMs, and that she has no male support except her father, who is aged person, therefore it is difficult for her to travel from Hyderabad to Vijayawada. For these reasons, she prayed for transfer of OP from Vijayawada to Hyderabad.
3. Respondent did not file any counter disputing the affidavit averments of petitioner.
4. Heard both sides.
5. Advocate for respondent submitted that respondent is a
contractor and it will be difficult for him to travel from Vijayawada to Hyderabad leaving his work, and if for any reasons, request of wife is considered, presence of respondent may be dispensed with before Family Court, Hyderabad.
6. Considering the submissions of both sides and considering the convenience of wife, O.P.No.65 of 2014 is withdrawn from the file of Family Court, Vijayawada, Krishna District and transferred to Family Court, Ranga Reddy District at L.B. Nagar for disposal in accordance with law.
Family court, Ranga Reddy shall dispense with the presence of husband i.e., respondent herein for each and every adjournment. However, respondent shall appear as and when his physical presence is felt necessary for any specific purpose.
7. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, pending in this petition, if any, shall stand closed.
