HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.176 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.5 of 2016 from the file of Family Court-cum-Additional District Judge, Mahaboobnagar, and transfer the same to Additional Family Court, Ranga Reddy at Malkajgiri.

Wife filed this petition seeking transfer. According to her affidavit, her marriage with respondent was solemnized on 17.08.2006 at Swagath Function Hall, Neredmet X Road, Secunderabad, as per Hindu rites and caste custom. She stated that she filed M.C.No.189 of 2008 and the same was allowed and she filed D.V.C. and the same is pending before Judicial First Class Magistrate, Malkajgiri. She further stated that a criminal case on the file of X Metropolitan Magistrate, Malkajgiri was dismissed and an appeal is preferred against it and the same is pending before XIII-Additional District and Sessions Judge, Ranga Reddy. For these reasons, she prayed for transfer of F.C.O.P.No.5 of 2016 from Family Court-cum-Additional District Judge, Mahaboobnagar, to Additional Family Court, Ranga Reddy at Malkajgiri.

Respondent did not file any counter disputing the affidavit averments of petitioner.

Advocate for respondent submitted that respondent has no objection for transfer of F.C.O.P., but some time may be fixed for disposal of F.C.O.P.No.5 of 2016 6.

Considering the submissions of both sides, F.C.O.P.No.5 of 2016 is withdrawn from Family Court-cum-Additional District Judge, Mahaboobnagar, and transferred to Additional Family Court, Ranga Reddy at Malkajgiri, for disposal in accordance with law. Additional Family Court, Ranga Reddy at Malkajgiri, shall dispose of the case within six months from the date of receipt of records. 7.

Transfer C.M.P. is ordered accordingly.
