THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE DR JUSTICE B. SIVA SANKARA RAO WRIT PETITION NO.6099 OF 2016 ORDER: (As per Hon'ble Sri Justice Nooty Ramamohana Rao) This writ petition is instituted for declaring the action of the sixth respondent in not passing any order in Tender Appeal No.17 of 2016 as an unjust act.

We are not impressed by the contentions canvassed herein for more than one reason. We are informed that the appeal was preferred on 13.02.2016, but however, it is urged that there is no regular Presiding Officer to the said Tribunal and consequently, the litigants are put to irreparable hardship not being in a position to secure appropriate interim orders. In the instant case, we are informed that during the pendency of the proceedings in S.A.No.370 of 2012 before the Debt Recovery Tribunal, Hyderabad, there is an order of status quo. Therefore, in the interests of justice, we consider that, it would be appropriate to maintain the same order of status quo for a further period of three months from today.

We hope and trust, that the petitioners herein will press their appeal before the sixth respondentTribunal and secure appropriate orders in the meantime. The sixth respondent shall deal with the Tender Appeal No.17 of 2016 or any interlocutory application moved therein, as is considered appropriate by it without any regard or reference to the order passed today by us. The said appeal or miscellaneous petitions will be dealt with on their intrinsic merits by the said Tribunal.

The writ petition stands disposed of with this order. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
