HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION Nos.43011 & 41997 of 2018 COMMON ORDER:

1) Since the issue involved in both the writ petitions is one and the same, the writ petitions are disposed of by this common order. 2) These writ petitions came to be filed declaring the action of the first respondent in trying to issue residential HMDA layout with land in Survey Nos.83/ A, 83/ AA, 83/ E, 83/ EE, 83/ RU, 75/ A, 75/ AA, 75/ E, 75/ EE/ 1, admeasuring different extents, situated at Annojiguda village, Ghatkesar mandal, Ranga Reddy District, presently Medchal - Malkajgiri district, in favour of the unofficial respondents, as illegal and arbitrary.

3) On 03.12.2018, this Court directed the respondents not to approve any layout, with regard to the subject properties, without taking into consideration the objections raised by the petitioner, if the same is not approved till date.

4) A counter came to be filed by the first respondent wherein para 6 reads as under:

" In reply to para 3 to 11, it is submitted that the petitioners mentioned that O.S.No.166 of and A.S.No.528 of 2008, in which the HMDA is not a party to the above cases. The process of final layout file is kept in pending till the outcome of High Court orders in A.S.No.528 of 2008. Hence it is denied that the HMDA is trying to issue final layout permission in favour of respondent no.2..."

5) From the above it is clear that the processing of the layout file would be kept pending till the outcome of A.S.No.528 of 2008. Hence no further orders are necessary in these writ petitions. 6) Accordingly, the writ petitions are disposed of in terms of para No.6 of the counter. No costs.

7) Consequently, miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
