Heard both sides.

The main contention in the counter of the respondent/husband, who is the petitioner in divorce O.P.No.1902 of 2016, pending on the file of Family Court, Miyapur, Ranga Reddy District, is that the wife even a government lecturer in Kadapa, she can attend Hyderabad to the Miyapur Court and it is difficult for him because he got aged parents and his mother is bed ridden, having sustained a fracture and he cannot afford to travel all the way and his special personal inconvenience must be taken care of in seeking to dismiss the petition.

Upon considering the submissions of both parties, to sub-serve the ends of justice, the transfer application is allowed in part and the O.P.No.1902 of 2016, pending on the file of Family Court, Miyapur, Ranga Reddy District, is withdrawn and transferred to Judge, Family Court, Kurnool, for restoration and early disposal. However, the Judge, Family Court, Kurnool, shall not insist the personal appearance of the respondent herein, if representing through counsel under Section 13 of the Family Courts Act so permitted, but for to reconciliation and giving of evidence etc.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
