These two writ petitions are filed challenging the action of the 3rd respondent in rejecting/repudiating the claim made by the petitioner on account of loss incurred for additional transportation charges/non-delivery of goods. 2.

The relationship between the petitioners and the 3rd respondent is governed by contract insurance. In such circumstances, the petitioners have alternative remedies to approach the Consumer Courts/Civil Courts. The writ petition under Article 226 of the Constitution of India is not a proper remedy.

Therefore, without expressing any opinion on the merits of the case, the writ petitions are disposed of giving liberty to the petitioners to avail the remedies available to them under law.
