THE HON'BLE SRI JUSTICE CHALLA KONDANDA RAM CONTEMPT CASE No. 99 of 2016 ORDER:

This Contempt Case is filed against the respondentTahasildar, Uppal Mandal, alleging violation of order dated 27.01.2015 passed by this Court in W.P.No.38366 of 2014. Notice was issued on 03.06.2016 and the respondentcontemnor appeared before this Court and filed a counter. While offering unconditional apology with respect to the delay in passing orders, the respondent submits that it is only on account of inadvertence and seeks condonation. The respondent also submitted that an endorsement dated 24.02.2015 was issued to the petitioner informing that the application in Form-X, said to have been filed by the petitioner, has not been traced out in the office. Pursuant to which the petitioner submitted an application dated 25.02.2015 with all relevant documents to the respondent. Thereafter, a Memo dated 23.01.2016 was issued to the petitioner setting out why the application made by him could not have been processed.

Having considered the rival submissions and especially in view of the submission of the learned Government Pleader that the Memo dated 23.01.2016 issued by the respondent to the petitioner shall be withdrawn and a reasoned order shall be made if an application is filed in proper form. However, there being some controversy with regard to the submission of the application along with documents, as on one hand the petitioner asserting that he has submitted an application along with documents, and on the

other hand the respondent having denied the receiving of documents whatsoever, the petitioner shall submit an application in Form VI-A, which is prescribed form along with relevant enclosures, which shall be processed by the competent authority after causing necessary enquiry in accordance with law. Accordingly, this Contempt Case is closed. There shall be no order as to costs. Consequently, pending miscellaneous petitions, if any, shall also stand closed.
