THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Arbitration Application No.40 of 2016 ORDER:

By its order dated 11.11.2016, this Court appointed Sri B.Naga Maruthi Sarma, retired District Judge, as the umpire to adjudicate the dispute between the parties, along with the two nominated arbitrators, in terms of the agreement and in accordance with law. Sri B. Naga Maruthi Sarma has since addressed letter dated 27.02.2017 stating that, in view of his appointment as the Presiding Officer of the Authority under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 by the Government of Telangana vide G.O.Ms.No.40 dated 22.02.2017, he was unable to proceed with the arbitration. It is, therefore, necessary that another arbitrator be appointed in his place. I consider it appropriate, therefore, to appoint Sri N.Raghava Rao, retired District Judge, H.No.

6-27, Brindavan Colony, Lingogiguda, Saroor Nagar, Ranga Reddy District, as the sole arbitrator. The Learned arbitrator shall fix his remuneration, and incidental charges for the arbitration proceedings, in consultation with the parties. He shall complete arbitration proceedings, and pass an award at the earliest, preferably within a period of six months from the date of commencement of arbitral proceedings. He is also requested to hold sittings, as far as possible, in the mediation centre of the High Court.

The Arbitration Application is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
