The petitioner was appointed as Field Assistant under NREGS Scheme on 19.05.2007 and has been discharging his duties since then. When the services of the petitioner were not extended through proceedings dated 23.08.2015 on the ground that he did not achieve the target, he filed W.P. No.27801 of 2015 along with five others and the said Writ Petition was disposed of by directing the respondents to place his case before the three-man committee by an order dated 31.12.2015. Thereafter, the three-man committee recommended his case for continuation and as such he is being continued as on today. While so, the second respondent issued an order of suspension on 12.09.2016 placing the petitioner under suspension in respect of the allegation that took place in 2007. Challenging the said order of suspension, the present Writ Petition is filed.

Learned counsel for the petitioner submits that the allegations relate to the period of 2007 and the petitioner is placed under suspension only in order to discontinue his services. But, this Court is not inclined to go into the merits of the case at this stage and, since there is some basis for initiating proceedings against the petitioner, this Writ Petition is disposed of by directing the second respondent to complete the enquiry initiated against the petitioner within a period of two (2) months from the date of receipt of a copy of this order and pass appropriate orders in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
