O R D E R
The prayer of the petitioner in this case is as under: 'For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 4th respondent in interfering in the civil disputes between the petitioner and the 5th respondent as illegal and consequently direct the 4th respondent not to interfere in the civil disputes and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case.'
The Inspector of Police, Kurnool II Town Police Station, filed a counter-affidavit, wherein he stated as under: '5. It is respectfully submitted that the 4th respondent i.e., Inspector of Police, Kurnool II town P.S. is never interfere with the civil dispute between the petitioner and Respondent No 5 and nobody police personnel of Kurnool II town P.S were involved in the civil disputes in between the petitioner and 5th respondent so far. In this regard, there are civil disputes between the petitioner and 5th respondent with regard to subject property in question, for which this respondent no-4 has nothing to do with it. Due to civil disputes between the petitioner herein and 5th respondent, the petitioner made baseless allegations in the affidavit which are far from truth.
Moreover the allegations of the petitioner are all of purely civil in nature. In this regard, I humbly submit that, the petitioners are trying to involve the 2nd, 3rd and 4th Respondents police into his personal and civil disputes.' The aforestated stand of the police authorities is taken on record. In the light thereof, no adjudication is warranted on merits. Ms. Avani Reddy, learned counsel representing Sri O.Manoher Reddy, learned counsel for the petitioner, is also agreeable to closure of the case recording the stand of the police authorities.
The writ petition is closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 28th APRIL, 2016 Svv
