HON'BLE SRI JUSTI CE SANJAY KUMAR AND HON'BLE Ms. JUSTI CE J. UMA DEVI WRI T PETI TI ON No. 34958 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Sri T. Rajinikanth Reddy, learned counsel for the petitioner, states that pursuant to the impugned e-auction notice dated 18.06.2017, the Corporation Bank held the auction sale on 18.07.2017 and a sale certificate was also issued to the auction purchaser. Smt. V. Dyumani, learned counsel for the second respondent-Bank, would inform this Court that the balance sale consideration, after appropriating a portion thereof towards the outstanding dues of the Bank, was also credited to the account of the petitioner. However, Sri T. Rajinikanth Reddy, learned counsel for the petitioner, would seek leave to withdraw this writ petition reserving liberty to the petitioner to invoke the statutory remedy available to him in accordance with law.

The writ petition is accordingly dismissed as withdrawn with the liberty aforestated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
