Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) The conditional interim order, dated 27-072016, in IA.No.444 of 2016 in Securitisation Appeal No.178 of 2016 on the file of DRT-3, Kolkata, Incharge DRT, Visakhapatnam (for short 'the Tribunal'), is assailed in this Writ Petition.

By the impugned order, the Tribunal has granted two weeks' time to the petitioner to pay the balance due amount of Rs.80 lakhs.

When the Writ Petition came up for admission and hearing before this Court on 10-08-2016, the learned Counsel for the petitioner requested this Court to adjourn the case till 12-08-2016 to enable his client to deposit atleast 50% of the balance due amount in order to show his bona fides.

Today, at the hearing, Mr.T.D.Phani Kumar, learned Counsel for the petitioners, submitted that his client is unable to pay any part of the amount as undertaken by him till today.

In the light of the above facts, we do not find any reason to interfere with the order of the Tribunal.

The Writ Petition is, accordingly, dismissed. As a sequel to dismissal of the Writ Petition, WPMP.No.26947 of 2016, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J)
