THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI Writ Petition Nos.35660 and 35880 of 2017 COMMON ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) After arguing for sometime, Sri M.Govind Reddy, Learned Counsel appearing on behalf of the petitioners, would submit that, instead of adjudicating these Writ Petitions on its merits, it would suffice if this Court were to permit the petitioners to submit a detailed representation to the Pollution Control Board seeking their consent for running the Units, and the Pollution Control Board is directed to take necessary action thereupon in accordance with law. Sri T.V.Ramana Rao, Learned Standing Counsel for the Pollution Control Board, while contending that the petitioners may not be entitled for being granted consent for operations in the absence of their fulfilling the standards prescribed by the Board to minimise air pollution, would further submit that the Board would examine the petitioners representation in accordance with law.

In the light of the submission of Sri T.V.Ramana Rao, Learned Standing Counsel for the Pollution Control Board, both the Writ Petition are disposed of permitting the petitioners to submit a representation to the Pollution Control Board which shall, within four weeks from the date of receipt

of the said representation consider the same strictly in accordance with law; and pass a reasoned order thereupon. Miscellaneous Petitions pending, if any, shall also stand disposed of.
