THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.41174 of 2016 ORDER:

Petitioner complains against the seizure of vehicle bearing No.AP 31 TG 6869 without procedure as illegal, arbitrary and unconstitutional.

Learned Government Pleader, on instructions, submits that the seizure of vehicle is on account of extraction of sand from unauthorized areas and the petitioner has to apply for appropriate orders under G.O.Ms.No.42 Industries and Commerce (Mines-II) Department dated 29.03.2016 and after such request is made to respondents 2 and 3, the same will be considered and orders are passed within one week from such representation.

The statement in placed on record. Petitioner is given liberty to represent to respondents 2 ands 3 for release of vehicle within one week from today and on such representation being made by petitioner, respondents 2 and 3 pass orders within seven (7) days from the date of receipt of copy of the representation. If the petitioner is required to comply with condition, respondents 2 and 3 are further directed to release the vehicle after the petitioner complying with the condition imposed by respondents 2 and 3.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
