HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33754 of 2016 ORDER:

This writ petition is filed for a writ of mandamus declaring the action of the official respondents, in particular, the 3rd respondent in calling the petitioner to the Police Station and making him to sit whole day and subjecting him to severe mental agony and trauma as illegal, high-handed, contrary to the settled Cannons of law and in violation of Article 21 of the Constitution of India.

Heard and perused the material available on record. 3.

The grievance of the petitioner is that the Station House Officer, Mamnoor Police Station, Hanmakonda, Warangal District (3rd respondent) is interfering with the civil dispute between the petitioner and respondents 4 to 6 and the 3rd respondent is calling the petitioner to the Police Station with an intention to detain him in the Police Station. 4.

Learned Assistant Government Pleader for Home submitted before this Court that number of criminal cases are pending against the petitioner and apart from that, a rowdy sheet is also opened against him.

Considering the rival submissions, the Writ Petition is disposed of with the following direction:

The Station House Officer, Mamnoor Police Station, Hanmakonda, Warangal District (3rd respondent) is directed not to interfere in any of the civil disputes between the petitioner and respondents 4 to 6. At the same time, this order will not stand in the way of the 3rd respondent to proceed with the investigation, if

any cases are registered against the petitioner for cognizable offences.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ RAJA ELANGO, J Date: 17th October, 2016 KL
