HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.42168 of 2018 ORDER:

Assailing the inaction of the 2nd respondent in hearing and finalizing the appeal dated 06.02.2017 filed by the petitioner under Section 8 of the A.P. Agricultural Land Conversion for NonAgricultural Purposes Act, 2006, this Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.

It is the case of the petitioner that he is the absolute owner and possessor of the land to an extent of Ac.1.00 cents in R.S.No.391/3A, 391/3B of Yandakuduru Village, Ghantasala Mandal, Krishna District, having purchased the same under registered sale deed vide document No.2734/2015, dated 28.09.2015 in the office of Joint Sub Registrar, Challapalli, Krishna District. Though the petitioner made an application dated 15.10.2016 for conversion of agricultural land into nonagricultural purposes, the same is rejected by the 3rd respondent vide proceedings dated 15.12.2016 basing on the report of the 4th respondent dated 06.12.2016. Aggrieved by the same, petitioner filed appeal on 06.02.2017 before the 2nd respondent. The only grievance of the petitioner is that though he filed appeal before the 2nd respondent on 06.02.2017, the same is not being disposed of.

Since the appeal filed by the petitioner is stated to be pending before the 2nd respondent, without expressing any opinion on the merits of the case, the 2nd respondent is directed to dispose of the appeal filed by the petitioner on 06.02.2017, after considering the contentions raised by the petitioner, in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, shall stand closed.
