THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26830 2016 ORDER:

This writ petition is filed by the petitioners with an apprehension that without considering their objections with respect to the LRS and BRS applications made by one Gunda Vijayalakshmi and others, the respondent authorities are going to consider the said applications.

It is the case of the petitioners that they are the owners and possessors of the land in Sy.No.623 (New) Survey No.711 (Old) situated at Prashanth Nagar, Waddepally Village, Hanamkonda Mandal of Warangal District, admeasuring 466.66 sq.yards, and 1022.25 sq.yards and open plot admeasuring 300 sq.yards and 100 sq.yards, out of Ac.1-25 guntas. The petitioners came to know that certain persons by name Gunda Vijayalakshmi, W/o Vasudev, Puskuri Sridevi W/o Saibaba Rao, Gottimukkala Ramchandra Reddy, S/o Narasimha Reddy, Biyyala Sisheer, S/o Janardhan Rao, Bommineni Vikram Reddy, S/o Narasimha Reddy, Sudula Vasanthamala, S/o Ratnakar Reddy, Azmeera Sriram, S/o Kasna, Kaluvala Shankar Prasad, S/o Rajeswara Rao and M.D. Mahaboob Ali Alias Chote, S/o Yakoob Ali, have applied for LRS and BRS for regularization of the layout.

It is further case of the petitioners that the said individuals have applied for LRS and BRS scheme with forged documents and they have no semblances of the right over the said properties. Bringing these aspects to the notice of the Special Officer of the 3rd respondent, petitioners filed their objections on 14.03.2016; 16.03.2016; 23.03.2015 and also on 01.06.2016 and they prayed for consideration of their objections before processing the applications made by the said individuals.

Heard the learned counsel for the petitioners and learned Standing Counsel for the respondents.

A perusal of the objections / applications made by the petitioners do not disclose any details with respect to the alleged LRS and BRS applications said to have been made by the above individuals. As it is not possible for the authorities to go on enquiring on every complaint, without there being any details, the writ petition as framed cannot be ordered by giving a direction to the respondents to consider the objections of the petitioners. However, in the facts of the present case, interest of justice would be served if liberty is given to the petitioners to approach the respondent authorities by filing a fresh application, clearly setting out the names of the persons who had made applications and also other details in detail. As and when such application is made, the same shall be considered before processing the LRS and BRS applications of the persons, against whom petitioners seek to raise objections. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.

Consequently, the Miscellaneous Petitions, if any pending, shall stand closed.
