HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40111 of 2016 ORDER:
Heard the learned counsel for the petitioners and learned Government Pleader for Revenue and, with their consent, the writ petition is disposed of at the admission stage.
The action of respondent No.2, in canceling allotment of land to respondent Nos.4 to 12 and seeking to evict the petitioners without following the procedure established by law, is questioned in this Writ Petition, as being illegal and arbitrary.
Though several contentions are urged before this Court, learned counsel for the petitioners, however, restricts his submission that the respondents may be directed to follow the procedure in accordance with law while evicting the petitioners.
Learned Government Pleader for Revenue, on instructions, would submit that surplus land was allotted to 14 scheduled caste beneficiaries who in turn, transferred the land to the petitioners; that by the impugned proceedings dated 30.03.2015 allotment was cancelled; that the third respondent was directed to evict the petitioners, who are encroachers, after following the procedure established by law; and, since the petitioners are encroachers, any action to evict
them from the subject land would only be in accordance with law.
Recording the submission of the learned Pleader for Revenue that the encroachers would only be dispossessed from the subject in accordance with law, the Writ Petition is closed.
Miscellaneous Petitions pending, if any, shall also stand closedNo order as to costs.
