THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.9912 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in opening rowdy sheet No.629, dated 16.07.2013, against the petitioner, as illegal and arbitrary, and consequently to direct the respondent to pay a sum of Rs.2,00,000/- towards the damages for causing humiliation to the petitioner by opening a rowdy sheet.

Heard and perused the material.

Learned counsel for the petitioner after arguing for sometime confined his arguments with regard to closing of rowdy sheet against the petitioner. He submits that the petitioner has not committed any offence and he is not involved in any offences after opening of the rowdy sheet in 2013. He further submits that the petitioner is a graduate and is working in APSRTC on outsourcing basis and he commands respect in the society and he is not having any bad antecedents. The petitioner made representations, dated 17.02.2016 and 18.02.2016 to the second and third respondents respectively, seeking closure of the rowdy sheet against the petitioner, but no orders are passed by the second and third respondents till date.

Considering the facts and circumstances of the case, the second and third respondents are directed to pass appropriate orders on the representations submitted by the petitioner within a period of six weeks and till passing of the orders by the respondents, the respondents are directed not to call the petitioner to the police station in the guise of pendency of the rowdy sheet. However, this order will not stand in the way of respondents to call the petitioner for investigation if any case is registered for any cognizable offence against the petitioner.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 08.11.2016 pln
