Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development, Government Pleader for Endowments and Government Pleader for Revenue, Sri N.Praveen Kumar, learned standing counsel for R-4/Municipality.
The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the respondents 4 and 5 in trying to erect a permanent structure in the premises of Saibaba temple, Sircilla in an extent of 30 guntas situated at Sainagar, Manair Tiram, Sircilla, Karimnagar District, as illegal and arbitrary.
Though various grounds are raised in the affidavit, the learned counsel for the petitioner restricts his prayer stating that he will make a representation to the appropriate authorities bringing to light the rights of the petitioner and also the usage of the land by the temple existing as on today, which may be directed to be considered in accordance with law. The learned Government Pleader appearing for respondent does not dispute the same.
Without going into merits of the case, the Writ Petition is disposed of directing the Collector, Karimnagar District to consider the representation, if any, made by the petitioner within 2 (two) weeks from today, in which event, the same shall be
disposed of as early as possible preferably within a period of four weeks from the date of receipt of the said representation in accordance with law.
