HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.42237 of 2018 ORDER :

Aggrieved by the action of 2nd respondent in issuing the impugned notice dated 13.11.2018, proposing to conduct re-survey of the subject land, the petitioner has filed this writ petition.

Heard learned counsel for petitioner and the learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader produced written instructions saying that though the survey was fixed on 12.09.2018, the petitioner was not present as notices were served after the said date. As such, to comply with the orders of this Court in earlier writ petition, they have issued fresh notice to the petitioner.

Learned counsel for petitioner also submits that the notice was served to the petitioner after 12.09.2018, as such, the petitioner could not present for survey.

In view of above, I do not see any reason for the petitioner to object for conducting survey, since the petitioner himself sought for conducting survey in the earlier writ petition in W.P.No.20295 of 2018, and respondents want to conduct survey pursuant to the orders in the said writ petition. Therefore, this Court is at a loss to understand as to what is the prejudice caused to the petitioner.

Therefore, I do not find any merit in this writ petition and the same is accordingly dismissed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed. __________________________ A. RAJASHEKER REDDY, J 27th November, 2018 ajr
