THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9091 of 2016 ORDER:

This petition under Section 482 Cr.P.C., is filed by the petitioners/A.2 & A.3 seeking to quash the proceedings in Crime No.144 of 2013 of Ramagundam Police Station, Karimnagar District registered for the offence punishable under Section 420 IPC against them.

2. Heard learned counsel for the petitioners/A.2 & A.3 and learned Additional Public Prosecutor representing the State. It is also brought to the notice of this Court that the petitioners/A.2 & A.3 who are remanded to judicial custody by the jurisdictional magistrate is insisting for the presence of the petitioners even though charge sheet is not filed.

3. As seen from the complaint, there are certain allegations against the petitioners. Truth or otherwise of the allegations made in the complaint can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the police concerned are directed to complete the investigation without arresting the petitioners/A.2 & A.3. The petitioners/A.2 & A.3 are directed to appear before the investigating agency, as and when necessary and cooperate with the investigating agency. The learned Magistrate is also directed to dispense with the presence of the petitioners till the charge sheet is filed and summon them and obtain a bond from them to appear as and when summoned by the Court.

4. With the above direction, the Criminal Petition is disposed of.

5. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
