THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.33499 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in trying to demolish the house of the petitioner as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj and the learned standing counsel for Gram Panchayat.
The case of the petitioner is that he is the owner of plot No.2-52 in Block No.2, admeasuring 93.33 sq. yards situated at Chandampet village and Mandal, Nalgonda District. It is the further case of the petitioner that he got the property in question under a registered gift settlement deed dated 20.02.2015. The petitioner filed Writ Petition No.14361 of 2016 against the respondents herein. While ordering Notice before admission in the said Writ Petition, on 26.04.2016, this Court passed the following order:
"There shall be interim suspension as prayed for. If construction is being made by the petitioner either on the road or by encroaching into the public property the order of suspension which is granted now shall not enure to the benefit of the petitioner and the 4th respondent is entitled to take action against the petitioner.
While so, on 27.05.2016, the 2nd respondent issued the impugned proceedings in Memo No.722/2015-B4 (pts). Feeling aggrieved by the orders of the second respondent, the petitioner
preferred a revision before the first respondent vide Revision No.4385 of 2016.
At the time of arguments, the only request made by the learned counsel for the petitioner is to direct the first respondent to dispose of the revision as early as possible. The learned Government Pleader for Panchayat Raj and the learned standing counsel for Gram Panchayat also consented for the same. Having regard to the facts and circumstances of the case and the submissions made by the counsel for the parties, the first respondent is hereby directed to dispose of the Revision No.4385 of 2016 filed by the petitioner as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
