HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 3 0 3 0 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Divisional Police Officer, Adoni, Kurnool District, dated 23.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the petitioner herein lodged a complaint on 08.10.2018 with the respondent No.4 Station House Officer, Adoni I-Town Police Station, Kurnool District, against one (i) M.D.Veerabhadraiah Swamy @ Bhadrinath Swamy and (ii) M.D.Santhosh Kumar with regard to atrocity against a scheduled caste person by the upper caste persons that occurred on 07.10.2018 morning at 07.00 hours. The complainant stated that the accused abused him by naming his caste. Basing on the said complaint, a case was registered as F.I.R. No.

85/ 2018 dated 08.10.2018, for the offences under Section 3(1)(s) of SC & ST (POA) Act against the accused (A.1 and A.2) and investigation has been taken up by the Sub-Divisional Police Officer, Adoni. During the course of investigation, the complainant and three (3) witnesses have been examined and recorded their detailed statements. It is submitted that the then Investigating Officer transferred on 12.11.2018 and posted to Vijayawada Central and the present Investigating Officer taken charge on 14.11.2018.

It is submitted that the present Investigating Officer received Caste certificate from the complainant as 'S.C.Madiga" on 22.11.2018 from the Office of Tahsildar, Adoni Mandal and the Caste Certificate of the accused are awaited.

It is submitted that the present Investigating Officer resumed charge as Investigating Officer in the above F.I.R. on 14.11.2018. The Investigating Officer assures this Hon'ble Court that the investigation will be finalized as expeditiously as possible and file the final report before the competent Court."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the SubDivisional Police Officer, Adoni, Kurnool District, dated 23.11.2018, with a further direction to the respondent-police authorities to expedite the investigation and file final report, strictly in accordance with law, as expeditiously as possible.
