2018-12-03A.Rajasheker Reddy2 pages

THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.42244 OF 2018

O R D E R

The case of the petitioner is that he made application to the respondents for conducting survey and demarcation of the subject land, and in pursuance of his application, respondents 3 and 4 - Assistant Director of Survey and Land Records and the Mandal Surveyor, issued notice fixing the date for survey as 30.10.2018, but on the said date, no survey was conducted and thereafter, the respondents have not taken any action. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue, produced written instructions of 3rd respondent - Assistant Director of Survey and Land Records in Rc .A3/ 964/ 2018 dated 26.11.2018 and submitted that notice was issued to the petitioner for conducting survey on 29.11.2018, and that subsequently, the subject land was surveyed. Learned counsel for the petitioner submits that survey was not conducted properly and it was restricted to only some extent and that survey report was also not furnished.

It is to be seen that when the survey was conducted, it is obligatory on the part of the 3rd respondent to furnish report to the petitioner. In view of the same, 3rd respondent is directed to furnish copy of the report to the petitioner within a period of two weeks from the date of receipt of a copy of this order, and if the petitioner is aggrieved by the same, it is open to him to avail remedies available under law.

With the above direction, writ petition is disposed of. Interlocutory applications pending, if any, shall stand closed. No costs.
