HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42330 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in trying to dispossess the petitioners from their private properties situated in Plot bearing No.183 admeasuring 500 sq. yards of the 1st petitioner, Plot bearing No.185 admeasuring 500 sq. yards of the 2nd petitioner and Plot bearing No.184 admeasuring 500 sq. yards of the 3rd petitioner, forming part of Sy.No.1007, situated at Bhagyanagar Cooperative Housing Society Limited, Kukatpally Village, Balanagar Mandal, R. R District (now in Malkajgiri Revenue division of Medchal-Malkajgiri District), at the instance of third parties, without following due process of law, as illegal and arbitrary.

When the matter is taken up for hearing, the learned Standing Counsel for the respondents 2 to 6, would submit that officials of the respondents 2 to 6, are not interfering with the possession and enjoyment of the petitioners' property more particularly in trying to remove the compound wall without following due process of law and accordingly there is no involvement by any of the official of the respondents 2 to 6 in the said process. According to him, if any third parties are interfering with the said process, it is always open for the petitioners to avail the remedy available to them under law. The learned counsel for the petitioners submits that the statement made by the learned Standing Counsel for the respondents 2 to 6, may be recorded and the writ petition may be disposed of giving liberty to the petitioners to avail the remedy available under law, in case of any interference by the third parties.

Having regard to the above, and recording the statement made by the learned Standing Counsel for the respondents 2 to 6, that the officials of the respondents 2 to 6 are not interfering with the subject properties of the petitioners, the writ petition is disposed of giving liberty to the petitioners to avail the remedy available to them under law. In case of any interference by the officials of the respondents 2 to 6, the same shall be in accordance with law. No order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
