THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12527 OF 2018 ORDER:
This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A-1 and A-2, for grant of bail in Crime No.140 of 2017 of Annavaram Police Station, East Godavari District, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2.
Heard the learned counsel for the petitioners/A-1 and A-2, the learned Additional Public Prosecutor representing the respondent/State and perused the record.

The earlier bail application of the petitioner/A-1 was partly allowed by this Court vide order, dated 05.06.2018, in Criminal Petition No.3367 of 2018. It is brought to the notice of this Court that in the said order, the petitioner/A-1 was granted interim bail for one month to undertake treatment. Later, vide order, dated 09.07.2018, in I.A.No.1 of 2018 in Criminal Petition No.3367 of 2018, the said interim bail was extended up to 16.07.2018. It is also brought to the notice of this Court that trial has been commenced and some of the witnesses were examined. The petitioner/A-1 was already given the concession to obtain medical aid. The petitioners/A-1 and A-2 are not entitled for bail even on regular basis. Hence, the Criminal Petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed.

Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
