It is the case of the petitioner that notice dated 11.07.2016 in Form-1 under the provisions of A.P. Assigned Lands (Prohibition of Transfer) Rules was issued by the 4th respondent-Taahsildar, Manthani Mandal, Karimnagar District. Though the petitioner filed explanation on 20.07.2016, without passing final orders are passed, the respondents are trying to evict the petitioner from the subject property. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

When the petitioner filed explanation to the impugned notice dated 11.07.2016 issued by the 4th respondent and it is pending for consideration, the respondents cannot evict the petitioner from the subject property, without following due process of law. In view of the facts and circumstances, till final orders are passed in pursuant to the notice dated 11.07.2016 issued by the 4th respondent, there shall be stay of eviction of the petitioner from the subject property.

Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands closed. ____________________________ A.RAJASHEKER REDDY, J 19.09.2016 kvs
