THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.4406 of 2016 ORDER:

The prayer sought for in this writ petition is as under : " To issue a writ of Mandamus or any other appropriate writ or direction by declaring the action of the respondent No.2 in not considering the representation/objections submitted by the petitioners objecting to the consideration of application for grant of licence in favour of the 5th respondent as illegal and arbitrary and consequently direct the respondent No.2 to consider the objections/representation of the petitioners, dated 9.2.2016 before grant of licence in favour of the respondent No.5".

It is represented by the learned Government Pleader that the petitioners have submitted a representation, dated 09.02.2016 and the same was not considered and the petitioners were informed that further steps will be taken. The period of licence is from 1.7.2015 to 30.6.2016. After expiry of the said period, the Government have issued a fresh notification mentioning the period with effect from 1.7.2017 to 30.6.2019 during which period the licence will be in force. Therefore, no further cause would survive in the writ petition and the same may be dismissed. Keeping the said submission in view and looking into the facts and circumstances of the case, this Court is of the opinion that no further cause would survive in the writ petition and the writ petition has become infructuous.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
