THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6705 OF 2016 ORDER:
The complaint of the petitioner in this case is that the Station House Officer, Madhapur (Guttala) Police Station, is refusing to receive and register an offence on his complaint dated 25.02.2016. However, Smt. R. Annapurna, learned counsel for the petitioner, fairly concedes that the petitioner did not even approach the Superintendent of Police, Cyberabad, under Section 154(3) Cr.P.C. As the statute affords an efficacious remedy to the petitioner in the event the officer of the police station concerned fails to act, the writ petition is disposed of leaving it open to the petitioner to take recourse to the statutory remedies in accordance with law.
Needless to state, in the event any complaint is made by the petitioner pursuant to this order, the authorities concerned shall be mindful of the directions of the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh[1] and take appropriate action in accordance therewith. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
