Heard Sri P.V.Sai Krishna, learned counsel for the petitioner/husband. Sri T.Nataraj, learned counsel, states that he is instructed to appear for the respondent/wife and advanced arguments. This civil revision petition under Article 227 of the Constitution arises out of the order dated 01.11.2017 passed by the learned Judge, Family Court, Ranga Reddy District at L.B.Nagar, in I.A.No.819 of 2017 in O.P.No.692 of 2012. The said I.A. was filed by the petitioner/husband, being the respondent in the O.P., seeking adjournment of the matter till disposal of his petitions filed under SR Nos.9986 and 9987 of 2017. By the order under revision, the Court below adjourned the case to 06.11.2017 as a last chance.
The petitions under SR Nos.9986 and 9987 of 2017 were filed by the petitioner/husband in aid of his application seeking permission to be represented by a General Power of Attorney holder. Perusal of the documents relating to these petitions demonstrates that they were filed in the year 2012 initially, in as much as the petition was signed by the counsel on 21.12.2012. The said I.As. were re-presented only in the year 2017 after complying with the objections taken by the office. This shows the level of diligence shown by the petitioner/husband in pursuing the matter. That apart, even though the petitioner/husband failed to present himself, the Court below appears to have accepted his plea for an adjournment and posted the case on 06.11.2017. It is not open to a party to drag on the lis indefinitely merely because he is residing in another country. The conduct on the part of the petitioner/husband in entering his defence in the subject O.P. clearly
shows his utter carelessness and disregard. This Court therefore finds no reason to entertain this civil revision petition. More so, as the petitioner/husband cannot insist upon adjournment of the case to suit his own convenience in as much as he has not even gotten his petitions numbered till date.
The civil revision petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
