THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.6233 of 2016 ORDER:

The petitioner who is the sole accused in Crime No.100 of 2016 of Ibrahimpatnam Police Station, Ranga Reddy District, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of his arrest in connection with the above crime, registered for the offences punishable under Sections 306, 420 and Section 493 of IPC.

Though the present application is filed seeking anticipatory bail, learned counsel for the petitioner restricts his prayer seeking a direction to consider his request for grant of regular bail on the same day of his surrender.

Learned public prosecutor opposed the application. Having regard to the facts and circumstances of the case and taking into consideration the request made, the petitioner if so advised, shall surrender before the concerned Court and move an application for grant of bail before appropriate Court, after giving prior notice to the Public Prosecutor, in which event the same shall be dealt with in accordance with law, on the same day.
