O R D E R
The prayer of the petitioner in this case is as under: 'The Hon'ble Court may be pleased to issue an order or orders or direction or a writ one in the nature of Writ of Mandamus to declare the action of the 3rd and 4th respondents in interfearing in civil disputes and harassing the petitioner is illegal, arbitrary and violation of Articles 14, 19 and 21 of Constitution of India and consequently direct the respondents not to harass the petitioner and also not to summon the petitioner and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case.'
The Assistant Commissioner of Police, West Zone, Vijayawada City, furnished written instructions dated 17.02.2016 to the office of the learned Government Pleader for Home stating that the fifth respondent had lodged a complaint with the Bhavanipuram police station against the petitioner and thereupon an entry was made in the General Diary. During the course of enquiry thereon, the complainant was asked to submit documents but he failed to do so and no FIR was registered. The allegations levelled by the petitioner as to interference by the police authorities were denied. The Assistant Commissioner stated that he had never summoned the petitioner to the police station or directed him to appear before the police authorities before a particular date.
He further stated that as no FIR was registered against the petitioner, the question of calling him to the police station did not arise. According to the Assistant Commissioner, the police authorities were only discharging their legitimate duties and maintaining law and order. The stand of the police authorities as set out in the aforestated instructions is duly taken on record. In the light thereof, no adjudication is warranted on merits in this case.
