THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42196 of 2018 ORDER:

The grievance of the petitioner is that the revenue authorities are not taking any action upon his application dated 08.10.2018 in the context of grant of assignment/patta in relation to the land admeasuring Ac.2.00 guntas in Survey No.505 of Ravalkol Village, Medchal Mandal, MedchalMalkajgiri District. Perusal of the petitioner's application dated 08.10.2018 reflects that it was received by the office of the Tahsildar, Medchal Mandal, MedchalMalkajgiri District, on that very day itself. The claim of the petitioner is that he and his family members have been in possession and enjoyment of the subject land since 1983 and that they would be eligible for grant of assignment in terms of Government policy.

It is not open to the authorities concerned to receive an application made by a citizen and remain inactive thereon. In the event the request made in the said application does not warrant consideration, it is for the authority to pass a reasoned order and communicate the same to the party concerned. As the revenue authorities have not taken any decision on the petitioner's application dated 08.10.2018 till date, it would suffice at this stage to direct them to do so.

The writ petition is accordingly disposed of directing the revenue authority concerned to take appropriate action on the petitioner's application dated 08.10.2018 in terms of the prevalent Government policy with regard to assignment of Government land to deserving persons. It is made clear that this Court has not gone into the merits of the petitioner's claim and it is wholly up to the revenue authority concerned to take a

decision in the matter in accordance with the norms. This exercise shall however be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
