ORDER

Heard learned counsel for the petitioner. Mr. R. Vinod Reddy, learned Standing Counsel, takes notice for the respondents. With the consent of the learned counsel appearing for the parties, this writ petition is being disposed of finally at the admission stage. Learned counsel for the writ petitioner submits that the respondents are not taking any action, not considering and not disposing of the petitioner's representation dated 12.05.2016 and that the conduct of the respondents in not granting four instalments as sought for by him for payment of electricity consumption charges in a sum of Rs.1,91,64,044/- claimed in the H.T.C.C bill of April, 2016, is illegal and arbitrary.

The facts are not in dispute.

Learned counsel for the petitioner would submit that when similar demand was made and the petitioner was not in a position to pay the consumption charges for the months of December, 2015 and January, 2016, a Writ Petition in W.P.No.5114 of 2016 was earlier filed and this Court disposed of the said writ petition by order dated 18.02.2016, granting instalments. He would, therefore, pray that this writ petition also may be disposed of by granting instalments. Having regard to the facts and submissions, this Writ Petition is disposed of with the following directions;

The petitioner shall pay 1/3rd of the aforementioned amount on or before 30.06.2016. He shall pay a further 1/3rd of the said amount on or before 31.07.2016 and the entire balance amount due and payable on or

before 31.08.2016. The petitioner undertakes to pay the earlier arrears as per the directions of this Court in the earlier orders and also future consumption charges regularly. This undertaking is accordingly recorded. It is made clear that if the petitioner makes default in payment of any one of the instalments as indicated supra, the authorities are given liberty to proceed against the petitioner in accordance with the procedure established by law.

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition also shall stand closed. ________________________ M. SEETHARAMA MURTI, J 26th May, 2016 sj
