THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.32606 of 2016 ORDER :

The grievance of petitioner is that respondents are effecting recovery of One-Time Penalty on the seigniorage charges payable on the used sand from its work bills.

Both counsel agree on the point that the issue in the present case fell for consideration before this Court in several writ petitions, and that no independent adjudication is called for. Copy of the order dt.16.04.2015 passed in one such writ petition, viz., W.P.No.10657 of 2015, is placed on record.

For reasons alike, and in terms of the afore-stated order, the Writ Petition is disposed of directing that in case the seigniorage fee on the sand utilized by petitioner in the works executed by it was deducted from the bills and proof thereof is filed before the Assistant Director of Mines and Geology concerned, the penalty shall not be levied. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
